By the use of our website or purchase which implies both, you are agreeing to comply without dispute or protest to the following Terms and Conditions as they relate to our specific Delivery Policies and Program Rules and to the following provisions, conditions.



You the (customer) agree and are aware that Gray Matter Brands  only delivers to the physical location you have requested, not necessarily to the intended recipient. It may be necessary to deliver to security personal, a co-worker, an apartment management office, a doorman, front desk staff or other or similar person at the delivery location.


If the recipient is not present or accessible at the time of delivery then you (CUSTOMER) agree without dispute that we (Gray Matter Brands) has acted in good faith in its efforts to deliver your gift to the intended recipient and is in no way responsible for any claim of non-delivery to the final recipient. This may result in the flowers or gifts not ultimately being delivered to the intended recipient and you the (Customer) agrees that (Gray Matter Brands) will be held harmless by you the (CUSTOMER) and that (Gray Matter Brands) is in full and complete compliance with its duties or obligations as it relates to this entire agreement stated hearin. You the (CUSTOMER) further agrees that you shall pay all product costs and fees due that are associated with these types of "No Recipient Present" deliveries without dispute or any bank or financial institution "CHARGE BACK".  
 

In addition, (CUSTOMER) agrees the delivery person may leave your flowers or gift in a safe place like a porch or even with a neighbor or other person or persons that has agreed to accept your product on the recipients behalf if in fact it could be reasonably assumed that the product that has been delivered to the delivery location will be received by the intended recipient and this shall be at the sole discretion of the delivery person. This effort is made all to insure your flowers are delivered in a timely manor.
 


No “Guarantee” Of Product Delivery On The Requested Delivery
Date And No Guarantee Of Same Day Delivery:


Our (Customers) agree that (Gray Matter Brands) does NOT “Guarantee” any request for product delivery on any specific date and our (CUSTOMERS) have been given sufficient notification of this very important Program Rule and have acknowledged and reaffirmed the “No Guarantee For Specific Delivery Date" Disclosure in the checkout process in (Gray Matter Brands) shopping cart.  By picking a “Delivery Date “on our calendar, this shall constitute only a request and not a “Guarantee" of the date selected. 


Further (CUSTOMERS) agree that they have been given a fair warning of our strict “Delivery Policies” and any challenge, demand, or any act of non-compliance  in part or in its total, shall constitute a violation of (Gray Matter Brands) specific Terms and Conditions and Program Rules. You the (CUSTOMER) Shall Automatically forfeit your eligitibility any Gift Card Reward and shall officially no longer qualify for the same.


If you do not agree with any of our delivery policies then you (CUSTOMER) agree that (Gray Matter Brands) has made other suggestions and options available to send flowers including, contacting a local florist in the area they would like to send flowers or they may call a national floral wire service.


And Finally, our (CUSTOMERS) agree that in the event your flowers or gift is not delivered on the day requested for any reason whatsoever, then they will be delivered on the next possible and or agreed upon day, excluding holidays and Sundays after we have called the recipient of the flowers to arrange a delivery at a future date.

(CUSTOMERS) are aware, agrees and accepts completely and without dispute that (Gray Matter Brands) does NOT “Guarantee” any delivery times what-so-ever and that all deliveries are based on a “PRIORITY OF OCCASION” basis and are as follows:


(1) Funeral and Sympathy Occasions


(2) Business and Work Day Deliveries 


(3) Hospitals, Care or Rehab Facilities 


(4) Residential/Home and other types of Deliveries 


Some deliveries may be made as late as 7 PM.


A late delivery may be necessary to accommodate a second delivery attempt or on Holidays or just an extremely busy day.

 
 

The Product You Are Purchasing Is Designed By A Floral Professional And Will Be Based On The Designers Artistic Interpretation And Is Not A Duplication Of Any Product Image As Shown On Our Web Site.


 

(CUSTOMERS) are aware, agrees and accepts completely and without dispute that “Product Images Displayed On Our Site Are For Display Purposes Only” of possible artistic design Interpretations and suggestions using the similar or AVAILABLE flowers, floral variety’s colors and brands, containers, ornamentations and materials that the local florist has in stock and that meet our Quality and Freshness guidelines and that are geographically and or seasonally available.


(CUSTOMERS) are aware, agrees and accepts completely and without dispute that (SERVICE) uses an "Open Design Interpretation Method” of floral design which will include possible or probable substitution of individual floral variety’s and colors. This is also commonly referred to as ”Designers Choice”  and (CUSTOMER) agrees and Understands that (Gray Matter Brands) is only responsible to deliver products that fulfill the “Product Value Paid By The (CUSTOMER)” and this value will not include the $14.99 Service Fee Paid by the (CUSTOMER) and any delivery charge that has been deducted from the product value by the filling flower shop which will very based on what the filling flower shop charges to deliver to the location you have requested and then the remaining product value is what the florist will use to create and design the arrangement or gift you have requested based on their design interpretation, the Product Freshness and The Product Quality and not in any way what-so-ever a duplication or facsimile of the various product images that are displayed on (SERVICE) web site.

 
No Guarantee Of Stem Count Or Quantity OF A Particular Flower Variety:
 

(CUSTOMERS) are aware, agree and accepts completely and without dispute that neither (Gray Matter Brands) nor our designer’s “guarantees” any stem counts or specific quantity of a particular flower or color even if the image shown that you have based your selection on indicates a different number or quantity of a particular flower, filler or accent greens, floral variety on any of our flower arrangements unless specifically specified in the description. The value or your flowers or gifts is based on a local value and cost of product and materials and will vary from location to location.



Service Fees:
A $14.99 service fee will be charged on each and every product you order and orders that contain more than one product will be charged a separate “Service Fee” for each and every product contained within a single order.


Delivery Fees:
As is common and usual in the flowers by the wire industry, all product “Delivery Fees” the delivering florist will charge, will be taken out of the total product value you have paid and that is transferred to the delivering florist and should not to be confused with the Service Fee you pay on every individual product purchased.
